Strikethrough Pricing Disclosure (California and District of Columbia)
Strikethrough Pricing; Reference Price Definitions; Consumer Disclosure
1. Purpose; Scope; Placement. This Strikethrough Pricing Disclosure (this Disclosure) explains how
CowpokesWesternShop.com displays and calculates strikethrough prices in search results,
category pages, product display pages, and other marketing placements on
CowpokesWesternShop.com (collectively, the Site). This Disclosure is intended to provide clear,
non-misleading reference-price information to consumers and to be interpreted and applied in
a manner consistent with applicable consumer protection and pricing laws, including California
and District of Columbia requirements.
2. Key Terms.
1. "Strikethrough Price" means a price displayed with a line through it (or otherwise
presented as a prior, reference, "compare at," "was," "regular," "list", "MSRP" or similar price)
next to a current offered price on the Site.
2. "Current Price" means the price currently offered for sale on the Site for the item at the
time the consumer views the item (exclusive of taxes, shipping, and other amounts
disclosed at checkout).
3. "Was Price" means a prior price for the same item on the Site determined using one of
the following methods (as applicable and as disclosed on the Site):

1. Customer-Paid Median Method: the median price paid by customers for the
item on the Site during the prior ninety (90) days, excluding special promotions
(including holiday campaigns, limited-time deals, and clearance).
2. Offered Median Method: the median price offered by Cowpokes Western Shop
for the item on the Site for at least twenty-eight (28) days out of the prior ninety
(90) days, excluding special promotions (including holiday campaigns, limitedtime deals, and clearance).
4. "List Price" means the manufacturer's suggested retail price (MSRP) for the item.
5. "Special Promotions" means temporary promotional pricing events and categories that
are excluded from Was Price calculations as stated above, including holiday campaigns,
limited-time deals, and clearance.
6. "Seasonal Items" means items that are marketed or sold primarily during a particular
season or limited seasonal period, for which a longer lookback period may be used as
described in Section 4.2.
3. What a Strikethrough Price Means (and Does Not Mean).
1. A Strikethrough Price is a reference price provided to help consumers compare the
Current Price to either (i) a Was Price (as defined above) or (ii) a List Price (MSRP).
2. A Strikethrough Price is not a guarantee that the item was sold at that price to every
customer, for any particular duration, or in every channel.
3. A Strikethrough Price is not a representation that the Strikethrough Price is the
prevailing market price, the lowest price available elsewhere, or the price at which the
item is generally sold by other sellers.
4. When CowpokesWesternShop.com Uses Was Price vs. List Price.
1. Was Price Basis. If the Strikethrough Price is labeled or presented as a "Was Price" (or
similar), CowpokesWesternShop.com will base that Strikethrough Price on a Was Price
calculated under Section 2.3 and will apply the stated exclusions for Special Promotions.
2. List Price (MSRP) Basis. If the Strikethrough Price is labeled or presented as "List Price,"
"MSRP," or similar, CowpokesWesternShop.com uses the manufacturer's suggested
retail price as the reference price. CowpokesWesternShop.com uses List Price as the
basis for a Strikethrough Price only when, within the applicable lookback period, either:
1. the item was purchased by customers on the Site at the List Price; or

2. the item was offered by other retailers at or above the List Price. For nonseasonal items, the lookback period is the prior ninety (90) days; for Seasonal
Items, the lookback period may be up to one hundred eighty (180) days.
3. List Price Disclosure. Because List Price is an MSRP, List Price may not reflect the
prevailing market price and may differ from prices offered by
CowpokesWesternShop.com or other sellers at any given time.
5. How Savings or Percentage-Off Statements Relate to Strikethrough Prices. If the Site displays
a savings amount or percentage (for example, "Save $X" or "Y% off"), the savings is calculated
by comparing the Current Price to the Strikethrough Price shown for that item at the time of
display, unless the Site expressly states a different basis.
6. Accuracy, Updates, and Reasonable Basis.
1. CowpokesWesternShop.com intends that each Strikethrough Price have a reasonable
basis consistent with this Disclosure and that Strikethrough Prices not be presented in a
manner that is false, misleading, or likely to mislead a reasonable consumer.
2. Pricing, promotions, and availability may change without notice; Strikethrough Prices
may be updated, removed, or replaced (for example, switching between Was Price and
List Price) as underlying pricing history, promotional status, or manufacturer
information changes.
7. No Price-Setting; Independent Pricing. CowpokesWesternShop.com sets its own prices
independently. Nothing in this Disclosure is intended to suggest that any manufacturer,
supplier, or other retailer controls CowpokesWesternShop.com's resale prices, or that any
customer is required to adhere to any suggested resale price.
8. Governing Law; Venue (District of Columbia). This Disclosure and any dispute arising out of or
relating to Strikethrough Prices displayed on the Site will be governed by the laws of the District
of Columbia, without regard to conflict-of-laws principles, provided that nothing in this Section
limits any non-waivable rights or remedies available to consumers under applicable consumer
protection laws, including California law where applicable.
